Valet Parking Service Terms of Service

1. Valet parking service (hereafter referred to as "the Service") is a service in which GINZA SIX Retail Management Co., Ltd. (hereafter referred to as "the Company") accepts custody of vehicles at the GINZA SIX car stand and stores them in the garage of the GINZA SIX parking area (hereafter referred to as "the Parking Area"). When the customer is finished using the facility, the vehicle is returned to the customer at the designated location.


2. Vehicles which are permitted to use the Service shall be the vehicles that can use the Parking Facility as prescribed in the Parking Facility terms of use. The following types of vehicles cannot be accepted: vehicles that have not completed the vehicle certification (shaken) inspection, malfunctioning vehicles or vehicles that malfunction easily, significantly damaged vehicles or vehicles that can be damaged easily, vehicles that have interference with driving operations, special vehicles other than private passenger vehicles, old vehicles (carburetor vehicles), motorcycles and 3-wheel vehicles, and other vehicles judged by the Company to be unsuitable for provision to the valet parking service. The Service is provided during the GINZA SIX business hours (except on facility holidays, when the facility is closed due to shortened business hours, and at similar times), and the maximum vehicle storage period shall be 48 hours.


3. When using the Service, the user shall pay the valet parking service fee using a credit card approved by the Company. This fee is separate from the parking area use fee.


4. The Service is available only to GINZA SIX app members. In general, it can be used by making a reservation from the GINZA SIX app. Use without a reservation may be refused depending on the conditions and capacity of the Service use.


5. The methods of using the Service are as follows.
[1] Arrival
①Reception for use of the Service is conducted at the car stand on B2F of the Parking Facility. At this time, the user hands the vehicle key and GINZA SIX card or credit card to the valet staff, and completes the procedure for payment of the valet parking service fee.
②After reception, the user receives the valet ticket issued by the valet staff.
[2] Departure
①The user pays the parking area fee at the payment machine in the B4F waiting room lobby of the Parking Area.
②The user presents the valet ticket to the valet staff at the valet vehicle return counter.
③The valet staff returns the vehicle and key.


6. When using the Service, the user shall not leave any persons, animals, valuables (including items which are of relatively small objective economic value but have subjective value to the user), high-priced items, money, or other equivalent items inside the vehicle. The Company is not responsible for checking whether there are such items left in the vehicle, and shall bear no liability for damages or other losses resulting from damage to, death of, or loss of any persons, animals, property, or other items left in the vehicle.


7. In the event of damage, theft, or other loss of the vehicle occurring for reasons which are the fault of the company while the vehicle is in the valet custody, the Company shall be responsible for payment of compensation. The upper limit of such compensation shall be, except in cases of deliberate act or gross negligence by the Company, the insurance amount prescribed in the contract of the insurance engaged by the Company. The Company shall bear no liability for losses in the case of failures or damage that occurred even though the accepted vehicle was operated and driven correctly; for vehicle scratches, damage, or other loss, or trouble with the engine, auxiliary devices, or other components, which is not recognized as having occurred during the period of valet custody; or for damage, theft, or other trouble that was not the fault of the Company and which was reported by the customer after departing from the parking area.


8. The valet ticket shall be managed and stored appropriately by the user, and the person who, at the time of vehicle return, possesses the valet ticket that was issued by the Company when the vehicle was accepted shall be considered to be the valid recipient of the vehicle.


9. Before using this service, the user shall be aware that if the user loses the valet ticket, the Company shall require presentation of a driver's license, vehicle registration certificate, or other suitable document, and may be unable to return the vehicle until it can confirm that the user is the valid recipient of the vehicle.


10. When the vehicle passage between B2F and B4F of the Parking Area is congested,there may be delays in returning the vehicle to the user. Please wait in the B2F waiting area lobby.


11. The user shall understand that accepting the vehicle for valet parking service will add mileage to the vehicle and consume fuel as a result of travel between the designated reception or delivery location and the parking space.


12. The Company shall bear no liability for any damages to the user or vehicle occurring as a result of natural disaster or other incident of force majeure, riot, acts of terrorism, or other event that is not the fault of the Company.


13. In the event that the user fails to receive delivery of the vehicle by the designated delivery time without advance notice to the Company, the Parking Area workplace manager will contact the user and confirm the circumstances. If the user requests that a party known to the user pick up the vehicle, he or she shall communicate this to the Parking Area workplace manager and shall personally notify the party concerned. Depending on circumstances, when it is necessary to keep the vehicle in continued custody, the user shall pay the designated Parking Area fee for the extended period of time. When the vehicle is kept in continued storage, the storage location may be relocated to the mechanical garage. The vehicle shall not be delivered to the user's home or other location.


14. In the event that the user does not respond to the contact from the Parking Area workplace manager based on the preceding paragraph and has not picked up the vehicle when more than 7 days have passed after it was accepted by the valet parking service, the Company shall handle the vehicle as prescribed for abandoned vehicles in the Parking Area terms of use.


15. Use of this service may be refused due to circumstances of the Parking Area facility or the Parking Area space, or due to the type of the user's vehicle or other circumstances.


16. When the vehicle is accepted, it may be stored in the mechanical parking garage after first checking the vehicle size. In this case, if the mechanical parking garage does not operate due to failure of the mechanical parking equipment or other reason, time may be required in order to deliver the vehicle.


17. The Service is not available to persons involved with organized crime or other antisocial forces.


18. If the parking area staff concludes that the user may have been drinking alcohol, the staff may check with the user and provide information about proxy driving services.


19. When using the Service, the Parking Area terms of use shall apply within the range that does not conflict with these Terms of Service.


20. The Company may, without advance approval from the user, change the provisions of these Terms of Service and the Parking Area terms of use following notification to the user by posting the change contents on the Company homepage or other means that are suitable in light of the change contents. In such case, the change shall take effect on the effective date posted on the Company homepage or the effective date indicated in the other suitable means of notification.


GINZA SIX Valet Parking Reservation Service Terms of Service


GINZA SIX Retail Management Co., Ltd. (hereafter referred to as "the Company") hereby prescribes the following terms regarding use of the reservation service (hereafter referred to as "the Reservation Service") for the valet parking service available exclusively to GINZA SIX app members (hereafter referred to as "the Valet Service") at the GINZA SIX parking area (hereafter referred to as "the Parking Area") Use of the Reservation Service shall constitute consent by the user of the Reservation Service (hereafter referred to as the "Reservation Service User") to these Terms of Service, the Parking Area terms of use, and the Valet Service terms of service.


Article 1: Definition of the Valet Parking Reservation Service
The Reservation Service is a service that provides advance reservations via the Internet for use of the Valet Service provided by the Company exclusively to GINZA SIX app members.


Article 2: Changes to the Terms of Service
The Company may, without advance approval from the user, change the provisions of these Terms of Service following notification to the user by posting the change contents on the Company homepage or other means that are suitable in light of the change contents. In such case, the change shall take effect on the effective date posted on the Company homepage or the effective date indicated in the other suitable means of notification.


Article 3: Requesting a Reservation
1. Users of the Reservation Service shall make reservations for the Valet Service by following the designated procedure on the Valet Service website.
2. The reservation date shall be within 30 days of the request date, and sameday reservations shall be made by 1 hour prior to the start of use. The service cannot be used when there are no available spaces on the reservation date, or when reservations are not available on the reservation date. Reservations are valid for the reservation date only.
3. A single request may be used to request a reservation for 1 vehicle. Reservations for multiple vehicles require multiple requests.
4. For purposes including authentication and reservation confirmation for use of the Valet Service, when submitting a request, the user shall register information including the name of the Reservation Service user, a mobile phone number that can be used to contact the user on the reservation date, and the license plate number of the vehicle that will use the Valet Service.


Article 4: Completion of a Reservation
1. A reservation for use is completed when the Reservation Service user completes the reservation procedure described in the preceding Article and the "Reservation Completed" screen is displayed. Even when the "Reservation Completed" screen is not displayed, the reservation for use is completed if it is possible to confirm the reservation details for that Reservation Service user by means of the "Reservation Status Check" function on the valet service website.
2. In the event that there is a line of vehicles waiting to enter the Parking Area around GINZA SIX, the user shall wait in the same line of vehicles as other Parking Area users, even if the Reservation Service time has already arrived. This is necessary because the facility structure makes it difficult to pass or cut in front of other vehicles.


Article 5: Changing and Canceling a Reservation
1. If there is a change to the vehicle license plate number or other information registered when the reservation was requested, the Reservation Service user shall immediately change the registered information on the Valet Service website.
2. In order to change the reservation date, the Reservation Service user shall first perform the cancellation process by following the designated procedure on the Valet Service website, and shall then make a new reservation.
3. When canceling a reservation, the Reservation Service user shall perform the cancellation process by following the designated procedure on the Valet Service website by 1 hour before the reservation start time.
4. The cancellation process is not possible after the cancellation deadline in the preceding paragraph has been exceeded.
5. If the user decides not to use the Valet Service before the reservation start time and does not perform the cancellation process, the valet staff may contact the user at the mobile phone number which was registered by the Reservation Service user at the time when the reservation was requested.
6. If a Reservation Service user repeatedly or frequently cancels reservations without notice, subsequent reservations by that Reservation Service user may be refused.


Article 6: Handling of Personal Information
The Company fully recognizes that management of personal information is an important responsibility, and in addition to complying with the Act on the Protection of Personal Information, it shall establish a basic policy for personal information protection and communicate it thoroughly to all employees. It shall also continually carry out and maintain reliable personal information management. Details of the Company privacy policy are as indicated on the Company homepage (http://ginza6.tokyo/).


Article 7: Prohibited Acts
Users of the Reservation Service shall not engage in the following acts when using the Reservation Service.
[1] Acts which violate or may violate copyrights, intellectual property rights, privacy, or rights of personal portrayal of the Company or third parties in relation to the Reservation Service
[2] Acts which discriminate against or denigrate a third party, or which defame or discredit a third party
[3] Acts which modify, erase, or otherwise manipulate data of the Company or a third party
[4] Acts which impersonate a third party when using the Reservation Service
[5] Acts which involve unauthorized access to the Reservation Service equipment (meaning communication equipment, computers, or other devices or software prepared by the Company or a third party for the purpose of providing the Reservation Service; same below) or which interfere with or may interfere with the use or operation of this equipment
[6] In addition to the acts listed above, any acts which violate laws, these Terms of Service, or public order and good morals; acts which interfere with operation of the Reservation Service; acts which harm the reputation or credit of the Company, or infringe on the property of the Company; and acts which are harmful to the interests of the Company or a third party
[7] Acts which violate or may violate the laws of Japan or another country
[8] Other acts which the Company decides are inappropriate

Article 8: Suspension of the Reservation Service
1. The Company may temporarily suspend the Reservation Service without advance notice to the Reservation Service users when any of the circumstances below occurs.
[1] Urgent maintenance of the communications equipment, systems, software, or other element of the Reservation Service is performed.
[2] There has been a fire, power outage, earthquake, volcanic eruption, flood, tsunami, or other natural disaster, or communication trouble, system trouble, or other trouble.
[3] War, civil disturbance, riot, civil demonstrations, or similar event has occurred.
[4] The Company concludes that loads on the system have concentrated or there is a problem with security.
[5] The Company decides that it is necessary to temporarily suspend the Reservation Service for other operational or technical reasons.
2. The Company shall provide the Service when none of the circumstances listed in the previous paragraph exist, and the user shall be aware that use of the Service may be unavailable for these reasons before beginning use of the Service.


Article 9: Changes to Communication Equipment, Systems, Software, and other Elements, and Related Disclaimer
1. The Company may perform maintenance, repairs, or updates of the communications equipment, systems, software, and other elements related to the Reservation Service, or may suspend or terminate use of the service, based on its own discretion and without advance notification to or approval from the Reservation Service users. The users shall be aware that use of the Service may be unavailable for these reasons before beginning use of the Service.
2. The Company does not guarantee that the Company homepage, servers, emails sent from domains and other sources, contents, and other data do not contain computer viruses or other harmful data as a result of reasons that are not the fault of the Company.
3. The communications fees required for use of the Reservation Service shall be borne by the user.


Article 10: Governing Law
The establishment, binding force, execution, and interpretation of these Terms of Service shall be governed by the laws of Japan.


Article 11: Agreed Court of Exclusive Jurisdiction
The Company and the Reservation Service user agree that Tokyo District Court shall be the exclusive court of jurisdiction in the first instance in the event that a lawsuit involving the Company and the Reservation Service users regarding these Terms of Service becomes necessary.
